Approval of Memorandum of Understanding MOU19-16 with Comcast for the Installation of Communication Conduit As Part of the New Mexico 502 Project
Recommended Action
I move that Council approve Memorandum of Understanding MOU19-16 with Comcast for Installation of Communication Conduit as part of the New Mexico 502 (NM502) Project.

Body
The upcoming reconstruction of NM 502 (East Road) from Tewa Loop to Knecht Street will conflict with existing utilities through the corridor. The DPU will be reconstructing its water, gas, electric and sewer infrastructure to accommodate the new road design and storm drain system. Comcast will have the same conflicts and must reconstruct their communication infrastructure. This MOU is the instrument by which the DPU will design and construct the necessary duct bank required by Comcast to reconfigure their system and then sell the duct bank to Comcast. This arrangement has been successfully coordinated on a number of major road and utility projects in Los Alamos County. The advantages of this arrangement is having a single contractor install like infrastructure in a common trench eliminating the need for multiple contractors working in the same area. The DPU is partnering with the New Mexico Department of Transportation to bid its work with the road construction project through a Cooperative Agreement, and by including Comcast in our scope of work the NMDOT efforts are streamlined. Work has been closely coordinated with NMDOT, Comcast and DPU and the project is now scheduled for a March 1, 2019 construction start date.

MOU 15-4210 was executed in July 2015 for this same project and purpose. This MOU expired on December 17, 2017 due to the delays in starting the project...
