Recommended Action
I move that Council approve the vacation of easement within Tract K, a Subdivision of North Community No. 1
Utilities Manager Recommendation
The Utilities Manager recommends that Council approve the motion as presented.
Body
The easement to be vacated was created to accommodate a utility pole guy wire. The associated pole and guy wire no longer exist and the easement is no longer needed. The County Code grants Council the authority to sell, lease, exchange or otherwise transfer county-owned real property and interests in real property (Sec. 14-31 (4)).
Alternatives
If the vacation of utility easement is not approved the encumbrance on the property will remain.
