Recommended Action
I move that Council approve the vacation of easement within Replatted Lot 4C, a subdivision of North Community No. 1
Utilities Manager Recommendation
The Utilities Manager recommends that Council approve the motion as presented.
Body
The utility easement being vacated was created for a waterline that has been replaced. This waterline was replaced in 2003 and relocated into Sycamore Street. The easement is no longer needed. The County Code grants Council the authority to sell, lease, exchange or otherwise transfer county-owned real property and interests in real property (Sec. 14-31 (4)).
Alternatives
If the vacation of utility easement is not approved the encumbrance on the property will remain.
