Recommended Action
I move that Council approve Amendment 1 to AGR16-916 with Kutak Rock, LLP, Increasing the Contract Amount by $120,000 from $250,000 to $370,000, plus Applicable Gross Receipts Tax, for the Purpose of Providing Legal Advice and Counsel.

The County Manager recommends that Council approve this Amendment as requested.
Body
AGR16-916 with Kutak Rok, LLP for legal services was originally for $250,000 for a period of 5 years ending October 2020. The original amount has almost been exhausted and the purpose of this amendment is to increase the total compensation to a level that is estimated to be sufficient until the end of the original term. When the agreement was originally signed, the indicated amount was based on an estimate of potential services requested, however this amount varies dependent upon the level of services requested. The County only pays for services rendered, so if the requested amount is not fully expended by October 2020 the balance will be available for other budgetary needs.
The Notice terms are also being updated to reflect a new vendor address.
Alternatives
Council could choose not to approve the amendment or approve it for a different amount.
Fiscal and Staff Impact/Planned Item
The staff impact is minimal. The increased amount is funded through existing operating budgets in the County Council, County Manager and County Attorney departments.
