Title

Consideration of Approval of Amended and Restated Joint Powers Agreement (JPA) for the Regional Coalition of LANL Communities (RCLC).

Recommended Action

I move that Council approve the Amended and Restated Joint Powers Agreement (JPA) for the Regional Coalition of LANL Communities (RCLC).

County Manager's Recommendation

The County Manager recommends that Council approve this JPA as requested.

Body

The RCLC board has approved an Amended and Restated JPA.  In order for it to become effective, the governing bodies of the RCLC members must each approve it, and then it must also be approved by the State. 

 

The key changes are as follows:

 

Fiscal Agent - the updated JPA removes Los Alamos County as the sole designated fiscal agent.  In place of that , it indicates that the RCLC Board will enter into an agreement with a member of the Coalition to serve as the Coalition's fiscal agent.  The County's representative to the RCLC has previously conveyed to the RCLC that Los Alamos County does not want to be the fiscal agent in the future (previous Council formal action).  Based upon this and other RCLC board discussions, staff anticipates that after this JPA is effective, the RCLC will transition to another member as fiscal agent.

 

Powers - during a review of the JPA, some members expressed concern that that the powers enumerated in the original JPA were not clear enough.  The updated JPA provides much better clarity in this area.

 Alternatives

Council could choose not to approve the updated JPA.

Fiscal and Staff Impact/Planned Item

The staff and fiscal impact of initially approving the JPA is minimal.  After the JPA is effective and a new fiscal agent is selected, staff time currently spent on fiscal agent activities will be available for other tasks.
