I move that Council approve the vacation of Utility and Drainage Easement Within Lot 82, a Subdivision of Eastern Area No. 2
Utilities Manager Recommendation
The Utilities Manager recommends that Council approve the motion as presented.
Body
The portion of easement being vacated overlaps the home on this property. This portion of the easement is not needed and the owner desires to have it vacated. The County Code grants Council the authority to sell, lease, exchange or otherwise transfer county-owned real property and interests in real property (Sec. 14-31 (4)).
Alternatives
The property is for sale and the title company has raised a concern with the home encroaching on the easement. If the easement is not vacated the property sale could be affected.
