Recommended Action
I introduce, without prejudice, Incorporated County Of Los Alamos Code Ordinance No. 02-303 An Ordinance Amending Article II, Section 31(1) Of Chapter 14 Of The Los Alamos County Code Of Ordinances To Include Property Transfers Pursuant To The Local Economic Development Act And The Metropolitan Redevelopment Code and ask staff to assure that it is published as provided in the County Charter.
County Manager's Recommendation
The County Manager recommends that Council introduce this Code Ordinance.
Body
The proposed amendments to Section 31(1) of Chapter 14 grant express authority to transfer County-owned real property pursuant to the Local Economic Development Act (NMSA 1978, § 5-10-1, et seq.), and the Metropolitan Redevelopment Code (NMSA 1978, § 3-60A-1, et seq.) without having to follow the requirements of Sections 14-32 through 14-35. The amendment also removes the referenced authority conferred upon municipalities by the Urban Development Law, NMSA 1978, § 3-46-1, et seq., and the Community Development Law, NMSA 1978, § 3-60-1, et seq., as both were repealed in their entirety in 2007.

Previously, the County transferred property in LEDA projects pursuant to broad authority provided in NMSA 1978, § 3-54-1 as specifically provided for in Section 31(1). This revision makes it clear that real property transferred pursuant to LEDA, the Affordable Housing Act, the Metropolitan Redevelopment Act, as well as the broad authority to transfer real property pursuant to NMSA 1978, § 3-54-1 are exempt from the requirements of Sections 14-32 through 14-35 such as the pre-sale referendum requirement contained in 14-34(b) and the 95% assessed val...
