I move that the County Council approve the recommendation of the Planning and Zoning Commission in Case No. REZ-2024-0019; adopt the Findings of Fact and Conclusions of Law made by the Planning and Zoning Commission as the County Council’s Findings of Fact and Conclusions of Law, and I further move to authorize the Chair of the County Council to sign a final order prepared by county staff that is consistent with this motion.

The proposed minor zone map amendment would rezone the property legally identified as Eastern Area 3 Tract U, located at 1725 17th Street, Los Alamos, New Mexico, from Single-Family Residential (SFR-4) Zone District to Institutional (INS) Zone District.
Los Alamos County Capital Projects and Facilities submitted a Development Application (Case No. REZ-2024-0019) for this amendment. The Planning and Zoning Commission ("Commission"), responsible for reviewing and recommending zone map amendments to the County Council ("Council"), initially held a public hearing on August 28, 2024. The Commission voted 3-2 in favor of recommending the rezoning; however, per County Code, Section 16-72(f)(5)-b-9, at least four affirmative votes are required for approval. As this threshold was not met, the application was forwarded to Council without a formal recommendation.
On October 29, 2024, the Council considered the application and voted to remand it back to the Commission for further review and recommendation. The Commission held another public hearing on November 20, 2024, during which testimony and evidence were presented. Following deliberation, the Commission unanimously (7-0) determined that the application satisfied all decision criteria under Section 16-74(h)(3) of the County Development Code.
