Recommended Action
I introduce, without prejudice, Incorporated County of Los Alamos Ordinance No. 02-330: An Ordinance Amending Chapter 2, Article III, Sections 2-113 Through 2-115 of the Code of the Incorporated County of Los Alamos Adjusting the Compensation of the County Assessor, County Sheriff, And Probate Judge, as allowed by NMSA § 4-44-14 and ask staff to assure that it is published as provided in the County Charter.

Body
The Incorporated County of Los Alamos County is a Class H County under New Mexico law. NMSA § 4-44-14 establishes the maximum salaries Los Alamos County can pay certain part-time county officers including the County Assessor, the County Sheriff, and the County Probate Judge. The salaries for the County Assessor, County Sheriff and Probate Judge are in County Code Sections 2-113 through 2-115. These salaries were last increased in 2014 by the adoption of Los Alamos County Code Ordinance No. 02-249.
In 2018 the state legislature amended NMSA § 4-44-14 to increase the salaries payable to the part-time County Assessor, part-time County Sheriff, and the part-time County Probate Judge. This amendment will align the salaries paid for these part-time elected positions with the amounts under NMSA § 4-44-14.
The salary increases contemplated are as follows:
County Assessor: from $6,889 to $7,922 per annum.
County Sheriff: from $6,889 to $7,922 per annum.
Probate Judge: from $4,031 to $4,636 per annum.
If approved, the new salaries would become effective on January 1, 2023.

Public hearing for this item is scheduled for September 27, 2022.
Alternatives
Council could not amend these salaries at this time.
Fiscal and Staff Impact/Unplanned Item
There is no staff impact and the fiscal impact is minimal to each elected officials' office.
