Title

Approval of Amendment No. 1 to Agreement No. AGR 25-977 with Lumen Technologies Government Solutions, Inc. to Include Additional Services, Relocation of Internet Port, and Increase the Not-to-Exceeded (NTE) Amount from $300,000 to $500,000, plus Applicable Gross Receipts Tax and Lumen's Variable New Mexico Fees, Surcharges, and Other Associated Costs

Recommended Action

I move that Council approve amendment no. 1 to agreement no. AGR25-977 with Lumen Technologies Government Solutions, Inc. to include additional services, relocation of internet port, and increase the not-to-exceed amount to $500,000, plus applicable gross receipts tax and Lumen's variable New Mexico fees, surcharges, and other associated costs.

County Manager's Recommendation

The County Manager recommends that Council approve amendment no. 1 to AGR25-977, as requested.

Body

AGR25-977 with Lumen Technologies Government Solutions, Inc. began on September 22, 2025, covering various County services under a single agreement with a not-to-exceed (NTE) amount of $300,000.00 plus gross receipts tax. This agreement includes County-wide voice services. The NTE for the 36-month term was calculated using Lumen quotes and estimated monthly fees. Lumen includes additional fees (i.e. recovery fees, surcharges, franchise fees, etc.) to each monthly invoice. These additional costs are included in the taxes, and Lumen states that most are fees collected by the State of New Mexico.

Amendment no. 1 will adjust agreement AGR25-977 to update the location address of the disaster recovery site, the addition of the QWave and Microwave services, and increase of the NTE from $300,000 to $500,000.

The County is moving its disaster recovery site, requiring the internet circuit to shift from 400 Tijeras Ave., NW, Albuquerque to 123 Central Ave., Albuquerque, New Mexico. Exhibit C (Doc No. DOC-0001731430) details the new address and related costs for the original agreement’s term.

These services were previously procured, via Lumen's GSA contract pricing, in April of 2023. The QWave and Microwave provides optical wavelength service (OWS) which is the County's redundancy solution, via Microwave on the roof of the Municipal building. Lumen mistakenly neglected to include this service when AGR25-977 was negotiated and taken before Council.

Alternatives

No alternatives are available for this mission critical service.

Fiscal and Staff Impact/Planned Item

Contractual costs were adopted for the FY27 IM budget by Los Alamos County Council.
