Recommended Action
I move that Council adopt Incorporated County of Los Alamos Resolution No. 26-06, A Resolution Relating to the Issuance of the Incorporated County of Los Alamos, New Mexico Gross Receipts Tax Improvement Revenue Bonds, Series 2026 (The “Bonds”) in an Original Aggregate Principal Amount Not to Exceed $40,000,000 For the Purpose of Acquiring, Extending, Enlarging, Bettering, Repairing And Otherwise Improving a Broadband Communications System and Other Public Buildings, Facilities and Infrastructure; Authorizing the Distribution and Use of a Preliminary Official Statement Relating to the Bonds; and Authorizing Related Action in Connection With the Preliminary Official Statement.

The County Manager recommends that Council adopt Incorporated County of Los Alamos Resolution No. 26-06.
Body
Resolution No. 26-06 authorizes actions related to the issuance of the Incorporated County of Los Alamos, New Mexico Gross Receipts Tax Improvement Revenue Bonds, Series 2026, in an amount not to exceed $40,000,000. The purpose of the bond is to finance improvements to the County’s broadband communications system and other public buildings, facilities, and infrastructure.
The resolution approves the form and distribution of the Preliminary Official Statement (POS) referenced in Attachment C, for the bonds, subject to any necessary modifications by the County Manager or Administrative Services Director. It further authorizes the Council Chair and County Manager to execute a certificate confirming that the POS is deemed final, except for certain pricing and term details. These actions are taken pursuant to Ordinance No. 750, adopted November 18, 2025, which governs the issuance and sale of the bonds.
Alternatives
There aren’t alternatives to this action, because it is in course with the necessary steps to perform the bond sale which will then allow the issuance of an Official Statement.

This is planned for and ensures the County the ability to proceed with the sale of bonds.
