I move that the County Council approve Case No. REZ-2024-0019 based on the evidence presented to the Planning and Zoning Commission and the arguments made in favor of the application to the County Council, and I further move to authorize county staff to prepare a final order with Findings of Fact and Conclusions of Law to bring back to Council for final review and approval.

I move that the County Council remand Case No. REZ-2024-0019 to the Planning and Zoning Commission for further hearing with the following direction(s): ________________________, and I further move to authorize the Chair of the County Council to sign an order prepared by county staff that is consistent with this motion.

I move that the County Council deny Case No. REZ-2024-0019 based on the evidence presented to the Planning and Zoning Commission and the arguments made against the application to the County Council, and I further move to authorize county staff to prepare a final order with Findings of Fact and Conclusions of Law to bring back to Council for final review and approval.

The Planning and Zoning Commission failed to make a recommendation in accordance with Section 16-72(f)(5)-b-9. As a result, the request is forwarded to the County Council without recommendation.
Body
Los Alamos County Capital Projects and Facilities submitted a Development Application (Case No. REZ-2024-0019) to rezone the property at 1725 17th Street, Los Alamos, from Single-Family Residential (SFR-4) to Institutional (INS). The Planning and Zoning Commission, which reviews and recommends zone map amendments, held a public hearing on August 28, 2024. The Commission voted 3-2 in favor of recommending the rezoning to the County Council.
However, under County Code Section 16-72(f)(5)-b-9, approval requires at least four affirmative votes from the members present. Since this did not occur, the application was forwarded without a formal recommendation to the County Council, which has final decision-making authority on such amendments, as stated in Section 16-70(b)(1) of the Los Alamos County Development Code.
According to the Development Code, the County Council may decide to approve, deny, or remand the application back to Planning and Zoning Commission for further hearing. If the application is remanded, the soonest meeting date to meet notification requirements is December 11, 2024.
