Recommended Action
I move that Council approve Amendment No. 1. to Services Agreement No. AGR22-18a with All-Rite Construction, Inc.; AGR22-18c with GME General Building, LLC; AGR-22-18d with Pluma, Inc.; and AGR22-18e with R and M Construction LLC for On-Call Facility Construction Services in an Aggregate Amount Not to Exceed $10,000,000.00 Excluding Applicable Gross Receipts Tax.

On August 29, 2021, the County advertised a formal multi-source competitive solicitation for facility-related project construction activities through Request for Proposals No. 22-18. There were five separate contracts considered in the award. On February 1, 2022, Council approved entering into Agreements AGR22-18a, b, c, d, and e for an aggregate amount not to exceed $4,000,000.00 for a seven-year term through 2029. However, the contractor under AGR22-18b, requested termination of the contract with the County which was granted.
Upkeep and use associated with owning, operating, and maintaining facilities requires the support of licensed contractors to complete a range of activities including demolition, repairs, renewals, renovations, remodels, improvements, and enhancements. Through these contracts, the County can obtain such services from qualified and licensed contractors in a timely manner. Work undertaken with these contracts may include building remodels and upgrades to mechanical, electrical, and plumbing components including heating, ventilation, and air conditioning (HVAC) systems and fire sprinkler and alarm systems. Such services may be associated with the Capital Improvement Projects (CIP), Major Facilities Maintenance (MFM) Program or used to supplement facility maintenance operations and other programmed or urgent operational needs of the County.
The County has experienced a notable increase in projects, and construction needs. The County has utilized these contracts to complete various projects including Hilltop House Demolition Project, Betty Ehart Senior Center (BESC) kitchen equipment upgrades, and office renovations to accommodate new full-time staff.
An increase in the contract limit will ensure the County can continue to respond to construction needs without interruption, avoiding potential delays or risks, and ultimately expediting, responding, and completing projects in a timely manner.
Alternatives
Council could choose to not approve these Amendments, requiring staff to complete the procurement and execute additional contracts for these services resulting in more time and delays with completion several programmed projects across the County.
Fiscal and Staff Impact/Planned Items
The aggregate compensation of all agreements (AGR 22-81a, AGR 22-18c, AGR 22-18d, and AGR 22-18e) are not to exceed the sum of ten million dollars, ($10,000,000.00), excluding New Mexico gross receipts tax (NMGRT) for a seven-year term that began February 2022 thru February 2029 under the original agreement. The County shall pay compensation for performance of the services in accordance with each issued task order through applicable and properly appropriated funding sources.
Compensation shall be paid in accordance with the rate schedule set out in Exhibit "A," of the original agreement. The Capital Projects & Facilities Division of the Public Works Department will manage the agreement.
