Recommended Action
I move that Council approve Amendment No. 2 of AGR23-53 with LSP Data Solutions to extend the term to December 12, 2026 and increase the total compensation amount not-to-exceed $722,000, plus applicable New Mexico Gross Receipts Taxes (NMGRT), for e-Discovery services and expertise in response to Inspection of Public Records Act (IPRA) requests.
County Manager's Recommendation
The County Manager recommends that Council approve the Amendment No. 2 to General Services Agreement No. AGR23-53 with LSP Data Solutions as requested.
Body
Los Alamos County executed Agreement No. AGR23-53 (Attachment C) with LSP Data Solutions on December 13, 2023, with an initial not-to-exceed amount of $350,000.00, plus applicable New Mexico Gross Receipts Taxes (NMGRT). Amendment No.1 (Attachment B) was approved and made effective November 20, 2024, to increase the not-to-exceed amount to $630,000, plus applicable NMGRT. The term of AGR23-53 spans two years, with the County holding the sole option to extend for up to two consecutive one-year periods. Amendment No. 2 (Attachment A) is requesting to extend one of the four consecutive one-year periods and increase the compensation by $92,000 for total not-to-exceed compensation of $722,000.
LSP Data Solutions provides consultation services to the County's Records Information Management Division, helping manage IPRA requests to meet the requirements of legally imposed deadlines. LSP’s work has significantly reduced the backlog of IPRA documentation requiring review and potential for legal and financial impact. Continuance of this consultation service for an additional year is imperative to meet the strict requirements of IPRA: NMSA 1978, 14-2-1.
Alternatives
If Council chooses not to approve Amendment No. 2, Records Information Management Division staff will continue to research, gather, and respond to IPRA (Inspection of Public Records Act) requests, but may experience a backlog of what could have been outsourced.

Funds were budgeted in FY26 and will be budgeted in FY27.
