Approval of Expenditure from the Electric Distribution Fund for the Emergency Repair of Electric Service to the East Gate Area by DUB-L-EE, LLC

Recommended Action

I move that Council approve expenditure from the Electric Distribution Fund, in the amount of $343,804.53 plus applicable gross receipts tax, for a total of $368,515.49, for the emergency repair of electric service to the East Gate area by DUB-L-EE, LLC.

The Utilities Manager recommends that the Board approve the motion as presented.

Board, Commission or Committee Recommendation

The Board of Public Utilities approved this request at their work session on July 5, 2023 and recommends that Council approve the motion as presented. 

Body

On June 1, 2023, the written determination of the County's Chief Purchasing Officer, Annalisa Miranda, is that there exists a threat to public health, welfare, or safety.  The nature of the emergency is an electric line replacement along NM502 from the entrance site to the East Gate entrance.  The distance is approximately 1,300 feet.  (Reference Sec. 31-105). On that date a placeholder amount was estimated for the purposes of issuing an emergency PO and an electric line replacement (conduit) was installed by boring method.  After Dub-L-EE was able to assess the situation, a revised cost estimate of $195,000 was presented to the BPU for approval on June 21, 2023.  On June 28, 2023 the quote was again revised to clarify the scope of services as follows:

 

*  Emergency electric primary line replacement due to East Gate business park power line failure;

*  Emergency services installation of 1,300 feet of 4 inch PVC conduit by boring and open trench method;

*  Construction in State Road NM 502 includes traffic control and pavement repair.

 

The final invoice and supporting documents are attached.

 

Background:

The existing direct buried conductor feeding East Gate was damaged by lightning and was not repairable. To restore power to the East Gate businesses, a temporary electric conductor was placed on the ground to feed East Gate until a replacement conduit and new conductor could be installed. The Chief Purchasing Officer, Annalisa Miranda, may make an emergency procurement as described in Sec. 31-105 of the County Code of Ordinances for Emergency Procurements. Given that the temporary conductor laid on the ground was a safety hazard, Ms. Miranda determined that this situation was an emergency. She then issued a purchase order to DUB-L-EE for installing conduits required for this emergency repair.

 

DPU’s on-call contractor, DUB-L-EE, responded by installing bored conduits in NM-502 right-of-way from East Gate entrance to Entrance Park and in a few cases where they hit hard tuft had to open trench the highway shoulder or acceleration lane to complete the conduit installation. These open trench sections added cost to the repair. DPU’s line persons have completed installing the new conductor and equipment to complete this emergency repair.

Alternatives

None - this was determined to be a threat to public health, welfare and safety and repair was a required emergency action. 

Fiscal and Staff Impact

Budget is available in the Electric Distribution Fund.
