Approval to Enter Into a Temporary Construction, Access, and Utility Easement for Community Broadband Network Infrastructure in the Mirador Subdivision, Phase III, Cadena Loop, Which is Owned by A-19-A-1 Acquisition Group, LLC in White Rock, New Mexico
Recommended Action
I move that Council agree to enter into a temporary construction, access, and utility easement with A-19-A-1 Acquisition Group LLC, for the purposes of installation of the community broadband infrastructure in Mirador Phase III, Cadena Loop.
County Manager's Recommendation
The County Manager recommends that Council approve the item as requested.
Body
A-19-A-1 Acquisition Group, LLC is the property owner of the of the Mirador Subdivision, Phase III in White Rock, New Mexico. Mirador Phase III includes the entire Cadena Loop street, serving approximately thirty (30) single family residential homes.
Similar to Mirador Phase I and Phase II, the County may accept the dedication of right-of-way and utility infrastructure, however Phase III has not been recommended for acceptance by County staff, to County Council yet. Mirador Phase I and Phase II have been recommended accepted by County Council and the public right-of-way, including the utilities and roadway infrastructure is County owned and maintained.
If agreed to by both parties, this easement would allow the community broadband infrastructure (Atomic Fiber) to be installed in Mirador Phase III.
If Mirador Phase III is accepted by Council in the future, this easement would cease, as this right-of-way would now be County owned and maintained.
Alternatives
Council could choose not to approve this easement, thus Mirador Phase III Atomic Fiber infrastructure would not be constructed, leaving these approximately thirty residences without access to the Atomic Fiber network.
Fiscal and Staff Impact/Planned Item
The funds for installation of the Atomic Fiber Network in Mirador Phase are already accounted for in the overall project budget.
