Approval of Agreements AGR 23-37a to Franco’s Builder, LLC., AGR 23-37b to GME General Building, LLC., and AGR 23-37c to Jaypen Construction, LLC for On-Call Concrete and Other Related Services in an Amount Not to Exceed $4,000,000 Combined for all three Agreements Plus Applicable Gross Receipts Tax Over a Seven Year Period

Recommended Motion

I move that Council approve Agreements AGR 23-37a to Franco’s Builder, LLC., AGR 23-37b to GME General Building, LLC., and AGR 23-37c to Jaypen Construction, LLC, Inc. for On-Call Concrete and Other Related Services in an Amount Not to Exceed $4,000,000 Combined for all three Agreements Plus Applicable Gross Receipts Tax Over a Seven Year Period.

County Manager’s Recommendation

The County Manager recommends that Council approve the motion as presented.

Body

This work is critical to maintaining the County's existing concrete infrastructure. These contracts will help support the County crews as they are required to keep up with other duties such as roadway maintenance, weed cutting, and other concrete maintenance that they are already doing. 

 

The County advertised for a formal competitive solicitation for On-Call Concrete and Other Related Services on April 30, 2023 (IFB 23-37R). Four responses were received, and the evaluation committee is recommending award to three respondents, Franco’s Builder, LLC., GME General Building, LLC., and Jaypen Construction, LLC. The three agreements considered for award are included as Attachments A, B, and C.

 

This on-call concrete and other related services contract is an as needed, Task Order based contract with a term of seven years. The term of these Agreements shall commence June 14, 2023 and shall continue through June 13, 2030 unless sooner terminated, as provided herein. Compensation is capped at a combined total of $4,000,000 plus applicable gross receipts tax.

 

As the Public Works Department identifies a need for concrete and other related services, funds will be identified, a task order will be properly approved and issued. Contractor is solely responsible for the means, methods, and processes for completing the agreed tasks.  Project schedules, price, and completion dates shall be determined on a project-by-project basis as outlined in an approved Task Order and shall be dependent upon the urgency of the task issued. Contractor may be requested to perform any or all of the services and tasks in phases and as agreed to in a written Task Order.  The Contractor shall be paid in accordance with the rate schedule provided in Exhibit “A” of each agreement. 

 

Task order signature approval is based on the associated compensation in accordance with the Procurement Code. If a Task Order exceeds $200,000, the task order will be brought to Council for approval.  The availability of three contracts provides staff with the option to complete work based on quoted unit price, demonstrated availability, responsiveness, performance, and quality of previous work particularly when urgent needs arise. There is no obligation to offer a minimum amount of work or compensation to any Contractor. Staff will be responsible for tracking the expenditures of all contracts to ensure that contract limits are not exceeded.

 

Other County Departments may also utilize the On-Call Concrete and Other Related Services Agreement contract as needed.

Alternatives

Failing to award any of the contracts would require staff to follow Procurement Code processes to procure such services on an individual project by project basis and delays would ensue.
