Recommended Action
I move that Council approve Amendment No. 1 to Agreement No. AGR AGR23-53 with LSP Data Solutions to Increase the total compensation amount not to exceed Six Hundred Thirty Thousand ($630,000), plus applicable New Mexico Gross Receipts Taxes (NMGRT), for e-Discovery services and expertise in response to Information of Public Request Act (IPRA) and of IPRA: NMSA 1978, 14-2-1.
County Manager's Recommendation
The County Manager recommends that Council approve the Amendment to General Services Agreement No. AGR23-53 with LSP Data Solutions as requested.
Body
Los Alamos County executed Agreement No. AGR23-53 with LSP Data Solutions on December 13, 2023, with an initial not-to-exceed amount of $350,000.00, plus applicable New Mexico Gross Receipts Taxes (NMGRT). This original compensation will be fully utilized by November 30, 2024.
LSP Data Solutions provides consultation services to the County's Records Information Management Division, helping manage IPRA requests to meet the requirements of legally imposed deadlines. LSP’s work has significantly reduced the backlog of IPRA documentation requiring review and potential for legal and financial impact.
Terms: The initial agreement spans two years, with the County holding the sole option to extend for up to two consecutive one-year periods, plus one additional one-year period, unless terminated earlier as specified. Amendment No. 1 to AGR23-53 increases the total not-to-exceed amount from $350,000.00 to $630,000.00, plus applicable NMGRT.
Alternatives
Council could not approve this amendment and then the County's Records Information Management Division staff would continue to research, gather, and respond to IPRA (Inspection of Public Records Act) requests within the state-mandated timeframe.
Fiscal and Staff Impact/Unplanned Item
Large volume of documents requested via IPRA resulted in AGR total compensation depletion sooner than anticipated. Funds were budgeted in FY25 and will be budgeted in FY26.
