Recommended Action
I move that Council approve Services Agreement No. AGR 25-14 with Waste Connections of Albuquerque, LLC. in the amount of $1,593,242.24 plus applicable Gross Receipts Tax for Mixed Recycling Services.

Body
On July 5, 2024, the County advertised a formal competitive solicitation for Mixed Recycling Services through Request for Proposals No. 25-14. One (1) response was received on July 24, 2024, and the evaluation committee is recommending award to Waste Connections of Albuquerque, LLC.
The County will deliver, at its discretion, any or all recyclable materials collected through its residential and commercial recycling collection programs. The Contractor will accept mixed recyclable materials for recycling services at their facility for sorting, processing and marketing services. The commingled, recyclable material County is expected to provide will include, but is not limited to the following:
• Newspaper and Inserts (ONP)
• Corrugated Cardboard (OCC)
• Brown Paper Bags
• Plastics #1 - #7
• PET (#1) Plastic Bottles
• HDPE (#2) Natural and Colored containers
• Aluminum Foil & Cans
• Steel/Tin Cans
• Junk mail
• Shredded Office Paper (in clear bags)
• Other Paper
• Magazines and Catalogs
• Phone Books
• Paperback and Hardback Books
• Paper board to include cereal and cracker boxes
• Egg Cartons (cardboard only)
• Milk/Juice boxes
• Rigid Plastic Toys
• Metal pots and pans
• Small electronics with cords
On occasion, Los Alamos County will separately haul to Waste Connection of Albuquerque, office paper designated as Sorted Office Paper (“SOP”), Grades 1 and 2. Contractor will ensure that any SOP delivered by County will be processed and disposed of within North America. Waste Connections of Albuquerque shall provide written certification that any SOP was processed and disposed of within North America within forty-five (45) days of disposal of such materials.
Upon Council approval, the term of the Agreement shall commence on September 25, 2024 and continue for a seven-year term through September 27, 2031 unless sooner terminated.
Alternatives
Council could choose to not approve the agreement or postpone approval. However, this would adversely affect the recycling collection program.
Fiscal and Staff Impact/Planned Item
A conservative approach to the contract compensation amount for mixed recycling services was taking by assuming that the County will receive no rebate. However, the Contract is written so that the Contractor will share a portion of the collected recyclables value with the County based upon the pricing schedule as the Average Market Value (AMV) of the commingled materials.
The revenue share rebate shall be netted against the then current Processing Fee to establish the net due-to or due-from the County each month.
