Approval of Services Agreement No. AGR 27-836 with Dismuke Construction Company for On-Call Pavement Preservation Services in an Amount Not to Exceed $4,000,000 plus Applicable Gross Receipts Tax

Recommended Motion

I move that Council approve Services Agreement No. AGR 27-836 with Dismuke Construction Company for On-Call Pavement Preservation Services in an Amount Not to Exceed $4,000,000 plus Applicable gross receipts tax.

County Manager’s Recommendation

The County Manager recommends that Council approve the motion as presented.

Body

County Code of Ordinances Section 31-3(b)(4) allows the procurement of services and construction with a person that has a contract with the State of New Mexico or any other New Mexico governmental entity, for the item, services or construction meeting the same standards and specifications as the items to be procured. Dismuke Construction Company is a party to the State of New Mexico’s General Services Department Purchasing Statewide Price Agreement 60-80500-26-17234 (Attachment B). 

 

The Public Works Department recommends use of Dismuke Construction Company under the New Mexico Statewide Price Agreement for pavement preservation services.  A services agreement (Attachment A), reviewed and approved by the County Attorney’s Office, was prepared for these services.

 

Under the agreement, the Contractor shall provide on-call pavement preservation services that includes crack sealing of hot mix asphalt and joint and crack sealing of asphalt and concrete pavements. This service extends the life of existing roadways, delaying the need for more expensive pavement reconstruction. This service will primarily serve the Public Works Traffic and Streets Division on an as-needed basis.

 

The agreement is a Task Order-based contract. Task order signature approval is based on the associated compensation limits established in the Procurement Code. If a Task Order exceeds $300,000, Council approval will be required.  The availability of this agreement provides staff the option to complete work based on quoted unit price, demonstrated availability, responsiveness, performance, and quality of previous work particularly when urgent needs arise. There is no obligation to offer a minimum amount of work or compensation to the Contractor. Staff will be responsible for tracking the expenditures of the contract to ensure that contract limits are not exceeded.

 

Based on the current Statewide Price Agreement and if approved by Council, the contract term will commence October 7, 2026, and shall continue through July 19, 2030, unless sooner terminated or extended by contract amendment.

 

Other County Departments may also utilize the On-Call Services in this Pavement Preservation Agreement as needed.

Alternatives

Failure to award this agreement would require staff to procure these services on a project-by-project basis in accordance with the Procurement Code. This approach would require additional administrative time, extend procurement timelines, and could result in delays to the delivery and completion of individual projects.

.Fiscal and Staff Impact/Planned Item

The Public Works Traffic and Streets Division will be the primary user of the services in this agreement. Task orders will primarily utilize approved Traffic and Streets budget. Other funding sources will be identified in cases where other County Departments wish to use the services of this agreement.  

 

The Public Works Department, Traffic and Streets Division will oversee this agreement.
