Presentation and Possible Approval of Amendment No. 2 to Services Agreement AGR 22-31 with Wilson and Co. in the Amount of $17,477 plus Applicable Gross Receipts Tax for Construction Management and Public Outreach Services for Trinity Drive Safety and ADA Improvements
Recommended Action
I move that Council approve amendment no. 2 to services agreement AGR 22-31 with Wilson and Co. in the amount not to exceed $17,477 plus applicable Gross Receipts Tax for construction management and public outreach services for Trinity Drive safety and ADA improvements.
County Manager's Recommendation
The County Manager recommends Council approve the motion as presented.
Body
Following completion of a Road Safety Audit in 2016, Los Alamos County was awarded $6.75 million in Federal Highway Safety Improvement Program (HSIP) funding through the New Mexico Department of Transportation (NMDOT) for design, right-of-way acquisition and construction of safety improvements along the section of Trinity Drive (NM502) from Oppenheimer Drive to Knecht Street. Trinity Drive, also known as NM 502, is a state-owned highway.
Los Alamos County contracted with Wilson & Company Inc. for engineering and design services. Roadway alternatives were presented to the Transportation Board and on August 6, 2024, County Council selected a Hybrid Road Diet Alternative as the preferred alternative. A resolution of support was approved by Council on September 10, 2025.
Upon completion of the design, a final design review meeting with NMDOT was held on January 6, 2026. The NMDOT approved the final design and issued the construction agreement authorizing the County to proceed with bidding the project for construction on March 4, 2026.
Amendment No.1 to the agreement with Wilson & Company Inc. extended the term of agreement and was executed in November 2025 (Attachment A).
With Trinity Drive being the County’s primary thoroughfare and providing access to numerous businesses, the County requested Wilson & Company submit a proposal for public outreach services. As a result, Wilson & Company partnered with CWA Strategic Communications, an experienced public relations agency, to provide this service and lead and assist with public outreach during this major improvement project. Contracting public outreach services for this type of project aligns well with the goals of the Public Information & Involvement Plan (PIIP).
Amendment No.2 to the existing agreement with Wilson and Company increases the construction services component of the agreement by $17,477.75 from $147,381.00 to $164,858.75 for a new total Agreement amount of $609,601.75 excluding applicable Gross Receipts Tax. Costs are also detailed in Exhibit B-1 of Amendment No. 2 (Attachment B).
Alternatives
Council could choose not to approve this Amendment, requiring staff to perform public outreach.
Fiscal and Staff Impact/Planned Items
The current project grant funding received from the Federal Highway Safety Improvement Program (HSIP) currently allocates a combined $6,750,000 for construction and construction management (Attachment C). Given current construction estimates, this available grant funding will be sufficient to cover public relations during project construction.
