Consideration to Purchase Real Property Located in the Incorporated County of Los Alamos and Commonly Referred To as the Units of Sherwood Village Condominium #4, Comprised of Lot 5B of the Subdivision of Lot 5 of Commercial Parcel A of Sherwood Village Subdivision, for a Total Purchase Price of $927,470 plus Applicable Fees, and for the Purpose of Re-Aligning Longview Drive
Recommended Action
I move that the County Council approve the "Purchase and Sale Agreement for Real Property Located In the Incorporated County of Los Alamos Commonly Referred to as the Units of Sherwood Village Condominium #4 Comprised of Lot 5B of the Subdivision of Lot 5 of Commercial Parcel A of Sherwood Village Subdivision."
I further move that the County Council authorize the County Manager to execute this Agreement; take all necessary steps to effectuate the Agreement, and upon closing, execute any documents necessary to dissolve Sherwood Village Condominium #4 and dissolve any easements, covenants, and restrictions on the Real Property associated with Sherwood Village Condominium #4.

The County Manager recommends that Council approve the Purchase and Sale Agreement as requested.
Body
The purchase of property within the Sherwood Village area for the purposes of re-aligning Longview Drive has been contemplated for decades. Most recently, the 2021 White Rock Center Master Plan (link <https://www.losalamosnm.us/files/sharedassets/public/v/2/departments/community-development/documents/white-rock-town-center-master-plan-202110.pdf>) supported the road re-alignment for the purpose of creating a multi-modal street that serves as a "complete street" including widened sidewalks, streetscape amenities such as seating, landscaping, lighting, signage, shade, and bike racks, and public parking to create an activated "main street" feel.
The real property purchase includes three owners of the buildings that sit on commonly owned parcel (Attachment A). The addresses of the buildings are:
- 112 Longview Drive Suites A, B and C owned by the The Handy Family Trust;
- 124 Longview Drive owned by M&M Safe Holdings, LLC; and
- 126 Longview Drive owned by Attach Research, LLC.
The purchase agreement sets the purchase amounts at the Assessor's actual valuation and requires the Home Owner's Association (HOA) common ownership of the land to be dissolved. In addition to building a new public road, the County will demolish the existing buildings. They are in a state of disrepair and clearing the existing buildings will make way for new, higher density and mixed use development. It is not the intention of the County to develop anything except the road and associated public improvements.

Funding for the land purchase is available in the Economic Development Fund.
