Recommended Motion

I move that Council approve agreements AGR 23-73a to Bohannan Huston, AGR 23-73b to Geo-Test Inc., AGR 23-73c to Pettigrew and Associates, AGR 23-73d to Western Technologies, and AGR 23-73e to WSP USA Environment & Infrastructure Inc. for On-Call Geotechnical Services in an Amount Not to Exceed $2,000,000 Combined for all five Agreements Plus Applicable Gross Receipts Tax Over a Seven Year Period.

County Manager’s Recommendation

The County Manager recommends that Council approve the motion as presented.

Body

The County advertised a formal competitive solicitation for On-Call Engineering Services on April 13, 2023 (RFP 23-73). Eight responses were received, and the evaluation committee is recommending award to five respondents, Bohannan Huston, Geo-Test Inc., Pettigrew and Associates, Western Technologies, WSP USA Environment and Infrastructure Inc. There are five agreements considered for award (Attachments A, B, C, D, and E).

 

This on-call engineering services contract is an as needed, Task Order based contract with a term of seven years. The term of these Agreements shall commence June 28, 2023 and shall continue through June 28, 2030 unless sooner terminated, as provided herein. Compensation is capped at a combined total of $2,000,000 plus applicable gross receipts tax.

 

As the Public Works Department identifies a need for geotechnical services, funds will be identified, a task order will be properly approved and issued. Contractor is solely responsible for the means, methods, and processes for completing the agreed tasks.  Project schedules, price, and completion dates shall be determined on a project-by-project basis as outlined in an approved Task Order and shall be dependent upon the urgency of the task issued. Contractor may be requested to perform any or all of the services and tasks in phases and as agreed to in a written Task Order.  The Contractor shall be paid in accordance with the rate schedule provided in Exhibit “A” of each agreement. 

 

Task order signature approval is based on the associated compensation in accordance with the Procurement Code and if a Task Order exceeds $200,000, the task order would be brought to Council for approval.  The availability of five contracts provides staff the option to complete work based on quoted unit price, demonstrated availability, responsiveness, performance, and quality of previous work particularly when urgent needs arise. There is no obligation to offer a minimum amount of work or compensation to any Contractor. Staff will be responsible for tracking the expenditures of all contracts to ensure that contract limits are not exceeded.

 

Other County Departments may also utilize the On-Call Geotechnical and Construction Materials Testing contract as needed.

Alternatives

Failing to award any of the contracts would require staff to follow Procurement Code processes to procure such services on an individual project by project basis and delays would ensue.
