Recommended Action
I move that Council approve Amendment No. 3 to Agreement No. AGR AGR23-53 with LSP Data Solutions to exercise the County’s sole option to extend the agreement for a consecutive one-year renewal and increase the not to exceed amount to $938,000, plus applicable New Mexico Gross Receipts Taxes (NMGRT), for e-Discovery Services and Expertise in Response to Inspection of Public Request Act (IPRA) requests.

Body
The County and LSP Data Solutions entered into Agreement No. AGR23-53 on December 13, 2023, with a not-to-exceed amount of $350,000, with subsequent amendments dated November 20, 2024 and November 19, 2025 (Attachment B) to increase the not-to-exceed by $280,000 and $92,000 respectively. This amendment (Attachment A) will increase the not-to-exceed amount by $216,000, bringing the total compensation amount to $938,000, and exercises the County’s sole option to extend the agreement through December 12, 2027, for e-Discovery professional consulting services.
LSP Data Solutions provides highly valuable consultation services to the County’s Records Information Management (RIM) Division to support a high volume of Inspection of Public Records Act (IPRA) requests. These services are essential for efficiently managing and reducing outstanding IPRA documentation, ensuring compliance with legally mandated response timelines outlined in NMSA 1978, 14-2-1. The consultants deliver e-Discovery expertise, utilize authorized software and record tracking tools, and maintain necessary certifications throughout the agreement term.
Alternatives
Consultation work will end and the County’s RIM Division staff will continue to research, gather, and respond to IPRA requests, however the volume would continue to outweigh the resources and may cause delays.
Fiscal and Staff Impact/Planned Item
The costs of consultation services were approved for fiscal year 27.
