Title

Approval of Amendment No. 3 to General Services Agreement No. AGR 16-701 with Tyler Technologies in the Amount of $116,450.00, Plus Applicable Gross Receipts Tax for the Purpose of Implementing Time of Use “TOU” & Residential Demand Electric Rates

Recommended Action

I move that Council approve the award of Amendment No. 3 to AGR16-701 with Tyler Technologies in the Amount of $116,450.00 plus applicable gross receipts tax to implement Time of Use and Residential Demand electric rates.

Utilities Manager's Recommendation

The Utilities Manager recommends that Council approve the motion as presented.

Board, Commission or Committee Recommendation

The Board of Public Utilities reviewed this request at their regular meeting on September 17, 2025 and recommends that Council approve the motion as presented.

Body

The Board of Public Utilities and the County Council approved Ordinance No. 02-365 Electric Rate Schedule on April 16, 2025, and June 10, 2025, respectively. The ordinance includes Time of Use and Residential Demand rates, which will take effect no sooner than July 1, 2026.

Alternatives

If the amendment to this service agreement were rejected, the Department of Public Utilities would be unable to implement Time-of-Use or Residential Demand rates.

Fiscal and Staff Impact

Continue operating at a loss while failing to align customer usage with actual system costs.
