Title
Introduction of Incorporated County of Los Alamos Code Ordinance No. 02-323, An Ordinance Providing for the Registration of Vacant Commercial Buildings within the County of Los Alamos, New Mexico; Establishing Registration Requirements and Fees and Providing the Collection Thereof; Fixing Penalties for the Violation Thereof and Providing for the Enforcement Thereof
Recommended Action
I introduce, without prejudice, Incorporated County of Los Alamos Ordinance No. 02-323, An Ordinance Providing for the Registration of Vacant Commercial Buildings within the County of Los Alamos, New Mexico; Establishing Registration Requirements and Fees and Providing the Collection Thereof; Fixing Penalties for the Violation Thereof and Providing for the Enforcement Thereof, and ask staff to assure that it is published as provided in the County Charter.

I further move that the public Hearing for this Ordinance be set for January 25, 2022 and that there be held at least one town hall meeting to gather additional public input prior to that date.
Body
At the August 24, 2021 work session, Council had an initial discussion on options to address vacant buildings. A result of that conversation was an indication that there was interest in having an ordinance introduced that Council could consider.

Council Vice-Chair Robinson and Councilor Izraelevitz have worked with the County Attorney's office to develop Code Ordinance No. 02-323 which is presented here for introduction.

The ordinance provides for vacant building registration, fees associated with registration, as well as an enforcement mechanism.

Staff has noted that section 18-224 (d) may provide a level of discretion to the Code Enforcement Officer that could be difficult to manage.

Proposed Public Hearing Schedule:

Staff is suggesting a public hearing date of January 25, 2022 and at least one town hall meeting prior to that date to gather public input.
