Annual Review of the Board of Public Utilities Procedural Rules
Recommended Action
Review the Procedural Rules and request any updates or changes to them that will be incorporated for adoption by the BPU at the regular meeting on August 19, 2026.
Body
The Board of Public Utilities (BPU) shall begin its annual review of the BPU Procedural Rules (PR) in Attachment A. In August 2024, Council updated the Boards and Commissions' Orientation Manual and Procedural Rules (See Attachment B).
DPU staff has recommended a revision to clarify a process for bringing minor amendments or corrections to rate ordinances for public hearing before BPU. A proposed revision can be found at Section 4.6(B) to provide that a “rate ordinance presented to BPU for a minor correction or amendment regarding a clerical error within thirty (30) days of presentation for public hearing before or adoption by County Council need not be submitted in advance of the public hearing but may be acted upon by the BPU when submitted.” (See Attachment C).
Additionally, Section 1.9 of the PR states that each year during the August BPU regular session, each board member will affirm that he/she has received, read, understands, and agrees to abide by the PR and the applicable documents referenced in its Appendix. Appendix A is the reaffirmation signature sheet, which will be routed for signature after the August 19, 2026, regular meeting.
