Recommended Action
I move that the Board of Public Utilities approve Agreement No. AGR27-804 between the Incorporated County of Los Alamos and Kutak Rock, LLP in an amount not to exceed $150,000.00, plus Applicable New Mexico Gross Receipts Tax, for the Purpose of Providing Legal Services in connection with the Incorporated County of Los Alamos Utilities Operations and authorize the Utilities Manager to sign the agreement.
Utilities Manager's Recommendation
The Utilities Manager and County Attorney recommend approving the General Services Agreement as presented.
Body
The County has been using Kutak Rock, LLP for legal services as requested by the County Attorney in connection with the County's utilities operations. Kutak Rock is currently supporting DPU in renewing the Energy Coordination Agreement with the Department of Energy. Their current agreement expires on June 30, 2026 and AGR27-804 will run from July 1, 2026 to June 30, 2031 with no lapse of service.
Alternatives
Solicit new bids for outside legal services and potentially need to bring a new provider up to speed on current legal matters being administered by Kutak Rock.
Fiscal and Staff Impact
The term of this $150,000 agreement is for seven years. The approved FY27 budget will cover the estimated expenses associated with wrapping up the renewal of the ECA.
