Introduction of Incorporated County of Los Alamos Ordinance No. 739; an Ordinance Novating and Authorizing the First Amendment of a Lease with AT&T Mobility, LLC, for Replacement of Existing Antenna Collocation and Facilities at 280 North Mesa Road, Los Alamos, on the North Mesa Water Tower

Recommended Action

I introduce, without prejudice, Incorporated County of Los Alamos Ordinance No. 739; an Ordinance Novating and Authorizing the First Amendment of a Lease with AT&T Mobility, LLC, for Replacement of Existing Antenna Collocation and Facilities at 280 North Mesa Road, Los Alamos, on North Mesa Water Tower and ask staff to assure that it is published as provided in the County Charter.

Utilities Manager's Recommendation 

The Utilities Manager recommends that Council introduce this Ordinance.

Board, Commission or Committee Recommendation

The Board of Public Utilities reviewed this request at their regular meeting on October 22, 2025 and recommends that Council approve the motion as presented.

Body

AT&T has operated cellular service equipment on the North Mesa tank since 2021. This amendment will extend the lease an additional 5 years, revised the annual fee to current market rate, transfer the lease from Comnet Wireless, LLC to AT&T Mobility LLC, and authorize the equipment replacement on the water tank. The proposed equipment replacement has been reviewed and poses no conflicts with the tank operation or with the other wireless tenants on the tank. 

 

Proposed Public Hearing Schedule: November 18, 2025.

Alternatives

If the ordinance is not approved the AT&T equipment replacement on North Mesa tank will be delayed.

Fiscal and Staff Impact/Planned Item

A one time administrative fee in the amount of $15,000 will be paid no later than 60 days after execution of this amendment. The annual rent to occupy the water tank will be $21,000 beginning June 1, 2026 and will increase each year after by 3%.
