Title

Incorporated County of Los Alamos Code Ordinance No. 02-387; An Ordinance Amending the Department of Public Utilities' Water Service Rate Schedules, Chapter 40, Article III, Sections 40-171, 40-173 and 40-175, and adding new Sections 40-176, 40-177, and 40-178 to the Incorporated County of Los Alamos Code

Recommended Action

I move that the Board of Public Utilities recommend that Council adopt Incorporated County of Los Alamos Code Ordinance No.02-387; An Ordinance Amending the Department of Public Utilities' Water Service Rate Schedules, Chapter 40, Article III, Sections 40-171, 40-173 and 40-175, and adding new Sections 40-176, 40-177, and 40-178 to the Incorporated County of Los Alamos Code, with revisions to the effective dates of the last service charge period to “after September 30, 2027” in Sections 40-171(b) and (c) and “after June 30, 2027” in all other sections and forward to Council for introduction and adoption as revised.

Utility Manager's Recommendation

The Utility Manager recommends that the Board of Public Utilities approve the motion as presented.

Body

The ordinance presented on April 15, 2026 to BPU, was the correct version; however, all subsequent approvals of the ordinance were based on an inadvertently presented a version that was materially different from the ordinance introduced at BPU. Accordingly, the water rate ordinance adopted by the Council on June 30, 2026, is void. 

Based on the review of the ordinance presented on April 15, 2026, the recommendations below are being submitted for consideration-

Section 40-171(b) and (c): Change dates listed as “From 10/1/2027 through 9/30/2028” or “10/1/2027-9/30/2028” to “After 9/30/2027.”

Section 40-173(b) and (c): Change dates listed as “From 7/1/2027 through 6/30/2028” or “July 1, 2027 through June 30, 2028” to “After 6/30/2027.”

Section 40-175(b) and (c): Change dates listed as “July 1, 2027 through June 30, 2028” to “After 6/30/2027.”
