Recommended Action

I move that Council approve the Vacation of Utility Easement within Lot 168B, a subdivision of North Community No. 2.

Utilities Manager's Recommendation

The Utilities Manager recommends that Council approve this vacation of easement as requested.

Body

After the Cerro Grande fire, the sewer line within the property was relocated into the road.  The easement being vacated was for the abandoned sewer and is no longer needed.  The County Code grants Council the authority to sell, lease, exchange or otherwise transfer county-owned real property and interests in real property (Sec. 14-31 (4)).

Alternatives

If the vacation of easement is not approved, the encumbrance on the property will remain.
