Incorporated County of Los Alamos Code Ordinance No. 02-306, An Ordinance Amending Chapter 6 Animal Ordinance.
Recommended Action
I move that Council approve Incorporated County of Los Alamos Code Ordinance No. 02-306, An Ordinance Amending Chapter 6 of the Code of Ordinances of the Incorporated County of Los Alamos, and ask the staff to assure that it is published as provided in the County Charter.
Body
Amendments to Chapter 6 contained in Ordinance No. 02-306 include:
1. Revise the definition of Keeper to eliminate the more than six day time threshold before control or custody of an animal can be established.
2. Revise Sec. 6-6 Unreasonable animal noise prohibited. (a) to read Except for noises made by livestock, it is unlawful for anyone to own, keep or harbor any animal that habitually howls, yelps, whines, barks, or makes other noises in a manner which unreasonably disturbs the public peace.
3. Delete unneeded language from Sec. 6-12 Penalty. related to disposition of dangerous animals.
4. Add to Sec. 6-19 (a) 5) clarifying a failure to meet pet's wellbeing.
5. Sec. 6-21 establish Ashley Pond Wildlife Protected Area Designation.
6. Sec. 6-122 clarify redemption of impounded animals.
7. Sec. 6-124 clarify adoption of impound animals.
The amended ordinance will being considered for adoption at the December 12, 2023 public hearing.
As part of the public outreach for this ordinance, a Town Hall was held November 13, 2023 and public comment was solicited on the County website. The resulting public comments are shown in Attachment A of item #18046-23 (Discussion on Wildlife Feeding Ordinance and Review of Community Feedback).

Council could not approve this ordinance.
