Recommended Action
I move that Council approve the vacation of utility easements within A-8-A Property on DP Road.
Utilities Manager's Recommendation
The Utilities Manager recommends that Council approve this vacation of the utility easements as requested.
Body
The easements being vacated are associated with an abandoned sewer line that crosses the parcel heading east/west. The easement being vacated is situated in an area where the proposed housing development intends to construct its new apartment complex. An existing manhole will be relocated to move the sewer line further away from the new apartment complex footing and to provide sufficient spacing for maintenance purposes. At a later date, the grant of easements for this parcel will come before the Council meeting for approval. The developer requested to come back at a later date to properly track the grant easements for all new utility infrastructure that will be installed and transferred to the Los Alamos County Department of Public Utilities. The County Code grants the Council the authority to sell, lease, exchange, or otherwise transfer county-owned real property and interests in real property (Sec. 14-31 (4).
Alternatives
If the vacation of the easements are not approved, the encumbrance will remain on the property.
