Status of Draft Electric Coordination Agreement 2026 - 2036

Utilities Manager will provide Council an update on the negotiations with the DOE on the new Energy Coordination Agreement (ECA). A final draft of the ECA 2026 - 2036 was furnished to the County on December 19, 2025, however, it was labeled business sensitive and it is still a document in process that is not ready to be released to the public. BPU has formed a non-quorum working group to review the agreement and DPU has engaged Kutak Rock to assist with review of this agreement’s terms and conditions.
Alternatives
Another 120-Day extension to existing ECA is in process (April 1, 2026, to July 31, 2026) called Modification 25 while County and the DOE continue their negotiations.

If no agreement is in place, then the fiscal and staff impacts would be significant.
