Recommended Action
I move that Council adopt Incorporated County of Los Alamos Ordinance No. 740; an Ordinance Authorizing the Transfer of Certain County-Owned Real Property to the Richard Skotnicki and Pamela Skotnicki Revocable Trust and ask staff to assure that it is published as provided in the County Charter.
County Manager's Recommendation
The County Manager recommends that Council adopt Incorporated County of Los Alamos Ordinance No. 740.
Body
The owners of Lot 6 in the Mesa del Escena Subdivision have inadvertently paid property taxes on a small (0.056 acre) County-owned parcel in the Pedazo Y Subdivision, which is adjacent to their property. This parcel has been under County ownership since at least 1970.

The discrepancy appears to stem from a non-transfer of the Pedazo Y Subdivision parcel to the adjacent Lot 6, as indicated on a plat dated February 7, 1971. This oversight was not identified by the Tax Assessor's Office at that time.

Despite County ownership, this parcel has never been, nor is it intended to be, utilized by the County for any purpose. Transferring this property is in the County's best interest to resolve any existing or potential claims arising from the confusion regarding its ownership, as detailed in the accompanying Release and Settlement Agreement.

Pursuant to Section 203.1(f) of the County Charter, the transfer of County-owned property requires an ordinance. Furthermore, Section 14-31(6) of the County Code grants the County, with its municipal powers, the authority to sell or transfer real property in accordance with NMSA 1978 Section 3-54-1.

Given that the fair market value of the property, as determined by a qualified appraiser, is $5,100.00 (less than $25,000.00), the sale may proceed under NMSA 1978 Section 3-54-1(A). This...
