Recommended Action
I move that Council approve the Cooperative Use Agreement with the New Mexico Department of Transportation, including the related Maintenance Agreement attached to the Cooperative Use Agreement as Exhibit B, regarding the use and maintenance of the NM4 Crossing and Multi-Use Trail Improvement Project in White Rock to include a Pedestrian Hybrid Beacon, aka HAWK Signal, and Roadway Lighting.

On January 27, 2026, staff presented the design for the NM4 Crossing and Multi-use Trail Improvement Project to County Council and requested approval, pursuant County Code Section 38-191, the installation of a High-Intensity Activated Crosswalk (HAWK) Signal on NM4 approximately 550 feet east of La Vista Drive which Council approved.
The New Mexico Department of Transportation (NMDOT) requires the County to enter into a Cooperative Use Agreement for the construction, operations and maintenance of local government led projects within NMDOT rights-of-way. The purpose of this requirement is to ensure that all maintenance requirements are performed.
The project includes a Pedestrian Hybrid Beacon or HAWK Signal and associated streetlights for the pedestrian crossing, NMDOT also requires local agencies to enter into a separate Maintenance Agreement for maintaining new signal and lighting equipment. These agreements outline responsibilities between the County and NMDOT for the new infrastructure proposed for installation.
