On June 25, 2020, the County advertised a formal multi-source competitive solicitation for On-Call Materials Testing and Abatement Services through Request for Proposal No. 21-07. On October 20, 2020, Council approved three agreements as follows: AGR21-17a to Havona Environmental, AGR21-17b to Southwest Hazard Control, and AGR21-17c to Terracon Consultants, Inc. Subsequently, Terracon requested changes to the indemnity provisions of contract which they noted in their response to the RFP. The County Attorney has reviewed the requested change and determined it is acceptable to the county.

Council could choose to not approve the agreement with Terracon, which would reduce the number of contractors available with testing expertise and would limit staff's options regardless of availability, responsiveness, performance, and quality of previous work, potentially resulting in delays.
