Title

Amendment to Memorandum of License and Agreement Between the Bureau of Reclamation Department of Interior, Incorporated County of Los Alamos, New Mexico And the Middle Rio Grande Conservancy District for the Construction, Operation and Maintenance of a Hydroelectric Power plant at El Vado Dam.

Recommended Action

I move that the County Council approve the Middle Rio Grande Project Amendment Memorandum of License and Agreement, Intergovernmental Agreement No: 6-AG-53-05370_AMD1(2021).

The County Manager recommends that Council approve the motion as presented.

Body

In preparation of our fiscal year 2022 budgets, Electric Production Asset Management Team proposed and included needed fencing repairs and upgrades at the Abiquiu and El Vado hydroelectric facilities in the FY2022 O&M budget. At project initiation staff notified the U.S. Bureau of Reclamation (“Reclamation”) about the needed fencing upgrades.  It was at this time when Reclamation discovered that a section of the existing fence was located on a tract of land without an easement. 

 

To maintain physical security the County of Los Alamos has requested specific easements within the original footprint. The amendment simply includes Tracts E, F, G, and H into the original Memorandum of License and Agreement executed in 1985 for the purpose of operations and maintenance of the hydroelectric facility which includes maintaining the security fence at the site.

Fiscal and Staff Impact

The fencing repairs and upgrades were budgeted in FY2022.  Staff will administer the contract with a fencing company as part of regular O&M activities.
