Title
Approval of Agreement AGR22-925 and Amendment 1 to AGR22-925 Art Maintenance for "Industrial Machine", by Robert Davis
Recommended Action
I move that Council ratify AGR22-925 and approve Amendment 1 to AGR22-925 for Art Maintenance of "Industrial Machine"; and authorize the expenditure of up to $10,000 from the Art In Public Places Fund.
County Manager's Recommendation
The County Manager recommends that Council approve the expenses as requested.
Board, Commission or Committee Recommendation
The Art in Public Places Board (APP) agrees to amend the current maintenance agreement with Mr. Davis, the artist of the "Industrial Machine", to allow for an additional $2,000, in order to complete the repairs necessary for the "Industrial Machine".
Body
In 2022, the Art in Places Board arranged a service agreement #ARG22-925, with Robert Davis, artist of the "Industrial Machine". Although the amount of the agreement is allowable for County Manager approval signature, the contract was not submitted to Council for approval for the use of Art in Public Places fund as required by code, and therefore requesting the approval of the original agreement expenses from the Art in Public Places Fund in addition to the Amendment 1 expenses.

Additionally, Artist Robert Davis underestimated the work that needed to be done to the art piece in order to get it back in working order. The maintenance has surpassed the budgeted amount for the first three (3) years of the original agreement. Mr. Davis asked for additional funds to replace the battery and to fix or replace the solar panel on the roof, for an estimated cost of $1,600 which the APP Board approved at their regularly scheduled meeting on September 22, 2022.
Alternatives
County Council could deny this request for approval of the original agreement and the amendment.
Fiscal and Staff Impact/Unplanned Item
The Art in Public Places fund does have the funds to support this amendment.
