Title
Report out on Nuisance Code and Security Clearance Concern
Body
Background: Residents who brought forth a petition in November 2022 to delay approval of the Chapter 18 Nuisance Code revision raised concerns that code violations would have to be reported to LANL personnel security and could jeopardize security clearances, which are necessary for employment at LANL.
In January 2023, newly elected Chair Denise Derkacs requested a meeting with LANL management responsible for security to clarify reporting requirements and possible impacts of nuisance code violations for clearance holders. That meeting took place in February 2023. Attachment A is a summary presentation of the concern and results of the meeting.
Questions Asked: In the County’s code enforcement process, (1) at what point would a clearance holder have to report to personnel security and (2) at what point could a person’s clearance be at risk?
Responses:
• Reporting Requirements
̶ Courtesy Letter: No
̶ Notice of Violation: No
̶ Complaint/Citation: Yes
• Security Concerns
̶ Pattern of repeat offenses
̶ Demonstrated unwillingness to comply with laws
̶ Questionable judgment, untrustworthiness, unreliability
Outcome:
Nuisance code violations likely will not impact a person's security clearance.
